Welcome to KohMarket. By accessing or using our platform — including the website, any mobile interface, and related services — you agree to be bound by these Terms & Conditions ("Terms"). Please read them carefully. If you do not agree, do not use KohMarket.

1. About KohMarket

KohMarket is an online classifieds marketplace serving Koh Samui, Koh Pha-Ngan, and Koh Tao. It connects buyers, sellers, renters, agents, and local businesses operating across these islands in the Gulf of Thailand.

2. Eligibility

You must be at least 18 years old to create an account or post a listing. By registering, you confirm that you are legally capable of entering into a binding agreement and that all information you provide is accurate and current.

3. Account Registration

You may register using your email address or a supported social login (Google, LINE). You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@kohmarket.co.th if you believe your account has been compromised.

Each person may hold only one active account. We reserve the right to merge or close duplicate accounts.

4. Listings and Content

Users may post listings for property, vehicles, services, jobs, and other items permitted by the platform. When you post a listing or community post, you represent and warrant that:

  • You have the legal right to sell, rent, or advertise the item or service.
  • All information in your listing is accurate, complete, and not misleading.
  • Your content does not infringe any third-party intellectual property, privacy, or other rights.
  • Your listing complies with all applicable Thai laws and regulations.

KohMarket reserves the right to remove any listing or content at any time, with or without notice, that we determine in our sole discretion violates these Terms or is otherwise harmful to users or the platform.

5. Prohibited Content

The following are strictly prohibited on KohMarket:

  • Illegal goods, controlled substances, or counterfeit items.
  • Weapons, explosives, or items that facilitate violence.
  • Content that is sexually explicit, defamatory, harassing, or hateful.
  • Fraudulent listings, scams, or misleading pricing.
  • Spam, unsolicited promotions, or duplicate listings.
  • Content that violates Thai consumer protection, advertising, or data privacy laws.

6. Verification

KohMarket offers optional identity and business verification for agents and companies. Verification is intended to build trust; it does not constitute an endorsement by KohMarket of any user, listing, or transaction. Verified status may be revoked if we discover that documents or information provided were false or misleading.

7. Transactions and Payments

KohMarket is a listing platform. We do not process payments between buyers and sellers, and we are not a party to any transaction arranged through the platform. All agreements, payments, and disputes are solely between the parties involved. We strongly encourage users to meet in safe, public locations and to verify details before completing any transaction.

KohMarket is not responsible for the quality, safety, legality, or delivery of any goods or services listed on the platform.

8. Community Forum

The Koh Community forum is a space for island residents and visitors to share local knowledge, ask questions, and connect. Posts must be relevant to island life and must follow the community guidelines. KohMarket reserves the right to moderate, edit, or remove community posts that violate these Terms or disrupt the community.

9. Intellectual Property

All content on KohMarket that is not user-submitted — including the platform design, logo, code, and original text — is owned by KohMarket or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written permission.

By submitting content to KohMarket, you grant us a non-exclusive, worldwide, royalty-free licence to display, reproduce, and distribute that content on the platform and in related marketing materials.

10. Privacy

Your use of KohMarket is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the platform, you consent to the collection and use of your data as described in the Privacy Policy.

11. Disclaimer of Warranties

KohMarket is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the accuracy, reliability, or availability of the platform. We do not warrant that the platform will be free of errors, interruptions, or security vulnerabilities.

12. Limitation of Liability

To the fullest extent permitted by Thai law, KohMarket and its directors, employees, and agents shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the platform or any transaction facilitated through it, even if we have been advised of the possibility of such damages.

13. Indemnification

You agree to indemnify, defend, and hold harmless KohMarket and its affiliates from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the platform, your content, or your violation of these Terms.

14. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may close your account at any time by contacting us. Termination does not affect any obligations or liabilities incurred prior to termination.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the Kingdom of Thailand. Any disputes arising from these Terms or your use of KohMarket shall be subject to the exclusive jurisdiction of the courts of Surat Thani Province.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page and, for material changes, notify registered users by email. Continued use of KohMarket after changes are published constitutes acceptance of the revised Terms.
